General Terms and Conditions of Business

• 1 Scope of application

For the business relationship between Sunce e. V. (hereinafter referred to as “Seller”) and the Buyer shall be governed exclusively – also for all future business – by the following General Terms and Conditions in the version valid at the time of the order. The seller does not accept any deviating terms and conditions of the orderer, unless he has expressly agreed to their validity.

• 2 Conclusion of contract

Your order is triggered by clicking the button “Complete order”. With your order you declare bindingly that you want to purchase the goods. You will be informed about the receipt of your order immediately by e-mail. The confirmation of receipt is automatic and does not yet constitute a declaration of acceptance. The purchase contract is concluded when we accept the offer in your order to conclude a purchase contract by delivering the goods.

Cancellation policy for orders of jewelry, printed books and CD. Consumers are entitled to a statutory right of withdrawal. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed (§ 13 BGB).

by means of a clear declaration (a letter or e-mail sent by post) of your decision to revoke this contract. For this purpose, you may use the enclosed sample revocation form, which, however, is not mandatory.

To comply with the withdrawal period, it is sufficient that you send the notice of exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of revocation

If you revoke this contract, we must repay you the invoice amount including delivery costs within 14 days from the day on which we received the goods back intact. For this repayment, we will use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.

You must return or hand over the goods to us within fourteen days at the latest from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You shall bear the direct costs of returning the goods.

You will only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.

The return of the goods should be in the same shipping method as the original shipment. Exclusion or premature expiry of the right of withdrawal:

A right of withdrawal does not apply to deliveries of sound or video recordings (DVD and CD) in sealed packaging if the seal has been removed after delivery.

• 4 Reservation of non-availability

We reserve the right to refrain from executing your order if we do not have the ordered title in stock and the ordered goods are not available as a result. In this case we will inform you about the non-availability and refund any purchase price you may have already paid.

• 5 Payment methods

We offer the following methods of payment: Payment by credit card, Paypal and instant bank transfer.Selling price For EU countries applies: The prices listed in the respective offers represent final prices. They contain all price components including the value added tax of the respective country of the EU. The delivery and shipping costs are not included in the purchase price, they are available on the page “shipping costs”, are shown separately during the ordering process and are to be paid by you additionally. After delivery of the goods, the buyer will receive a separate invoice from Fedex Express for the handling of the duties such as customs and import tax. The amount of customs and import tax is different in each country, binding information can be obtained by the buyer from his respective customs authority. • 6 Shipping

• 7 Set-off, retention

The delivered goods remain the property of the seller until the complete fulfilment of the purchase price claim by the purchaser.

 

• 9 Warranty

If there is a defect in the purchased item, the statutory warranty provisions of §§ 434 et seq. BGB.

 

• Applicable law and place of jurisdiction

German law shall apply to the exclusion of the UN Sales Convention.

If the customer is a merchant or a legal entity under public law, the exclusive place of jurisdiction for all disputes arising from the contractual relationship is the court responsible for the seat of our association in:

• 11 Miscellaneous

Should individual provisions of these GTC be or become invalid, the remaining provisions shall remain unaffected.

The invalid or missing provisions shall be replaced by the respective legal regulations.

 

• 12 Sonstiges

Sollten einzelne Bestimmungen dieser AGB unwirksam sein oder werden, bleiben die übrigen Bestimmungen hiervon unberührt. An die Stelle der unwirksamen oder fehlenden Bestimmungen treten die jeweiligen gesetzlichen Regelungen.
